Fall Minis 2020

This year our Fall Minis will be held on the gorgeous grounds at the Bella Barn of West Tennessee that is located outside of McKenzie, TN. These will be held November 08, 2020. This is our favorite weekend of the whole year for peak fall leaves.

Each session is up to 20 minutes long, so at your preference we will have time to include a few of your favorite locations on the property into your session. We prefer a more natural lifestyle approach to our photos so there will not be any extra decor besides the gorgeous scenery and maybe a blanket for family snuggles. We will get the smiling poses for the Christmas cards but will focus more on the loving and interaction.

Session Details:
-Session Fee of $125. (Retainer fee of $65, Remainder fee of $60)
-Up to 20 minute session
-15-20 digital images delivered via online gallery
-All delivered digital images will be in both color and black and white
-Print release

-Your online gallery will be delivered by/on December 01, 2020. We want you to be able to have enough time to print all of the photos and cards for the holiday season.

Session may be rescheduled for illness or inclement weather. If anyone in your home is feeling under the weather on the day of the session please reach out so that we can reschedule you for when everyone in your home is well.

COPYRIGHT AND REPRODUCTION The client agrees that all copyrights and/or intellectual property rights for all photographs taken at the session shall be held exclusively by Garrett Photography. The client will receive images via online gallery, and may print at their discretion as well as purchase professional prints and items from the photographer. The client may also post images online and to social media (i.e. Facebook, Instagram, etc.) but must note Garrett Photography as the photographer and include a tag where feasible. The client is encouraged to back up their images upon receiving them. Your purchase of the original files releases GP from any liability due to loss or damage of the images, and also releases GP from any obligation to maintain copies of any digital file, image, or photograph.The client may not sell, distribute or take credit for any of the photos taken by Garrett Photography. GP highly recommends that photographs be printed only through a professional printing lab. If client prefers to print through a low quality printer, GP is not responsible for client being displeased with those printed products.

WAIVER OF LIABILITY RELEASE By agreeing to a photography session with Garrett Photography, I am hereby waiving, releasing, and discharging Garrett and all its affiliates, from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me or my family including my traveling to and from this event. GP is not responsible for any injuries inflicted upon any participating parties. Client(s) will be responsible for their children and for themselves and release photographer from any claims against their person or their business. Client swears that each person is participating voluntarily in the said photography session and forfeit all right to bring a suit against Nicole Garrett or Austin Garrett Garrett Photography for any reason. GP is not responsible for uncooperative parties. It is understood that the behavior of children is unpredictable, however, photographer is not liable if children do not cooperate during sessions.

Please be aware that booking fees are non-refundable, and that absolutely no refunds will be given after a session has taken place.

LIMIT OF LIABILITY: Although care will be taken with the digital files, the Photographer limits any liability for loss, damage or failure to deliver photographs for any reason of Photographers non-performance caused by any force or similar circumstances, illness, accident or any cause beyond their control. In any event, the limit of Photographer’s liability shall not exceed the contract price stated herein.

OWNERSHIP OF DIGITAL FILES: It is agreed that dual ownership of the digital files will be maintained by the Client and the Photographer. Upon delivery of the digital files to Client’s control, the client shall gain personal non-commercial rights to images. It is also agreed that the Photographer will have full rights to use all images for advertising purposes. The Photographer does NOT guarantee archival of the digital files passed a period of one year after the session/event date and will not be held responsible if loss occurs as per section. Online galleries are removed after six months and all images must be saved prior to the 6 month mark or a fee to re-upload or send a usb/cd will be charged.

DISPLAY or PROMOTION: It is agreed that the Photographer may display and use photographs from session/event for website and internet promotion, and any other non-commercial purposes thought proper by the Photographer.

RESERVATION DEPOSIT & PAYMENT SCHEDULE: Upon payment, the Photographer (Garrett Photography) reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the retainer of $65 of the balance is non-refundable, even if event date is changed or photo shoot cancelled for ANY reason. They can be rescheduled due to inclement weather. The final payment of $60 is due at the time of the session. Cash, check, Paypal, or Venmo to Nicole Garrett are acceptable.

GUARANTEED DELIVERY: Photographer agrees to have the contracted order for the photo-shoot photographs completed by/on 12/01/20. When your gallery is ready we will email/message/ or text your link.

INDEPENDENT CONTRACTOR: This Contract is not to be construed as an employment agreement in any way. The Photographer functions as an independent contractor.
